住宅大樓內及陽台可以抽煙嗎？Is smoking allowed in residential buildings or balcony ?

由於公寓、大樓與社區等私人範圍，並不屬於現行菸害防制法之全面禁止吸菸的限制場所範圍內，因此在自家住宅大樓的陽台吸菸並不犯法，原則上亦不會受罰。

但是，若是吸菸者的鄰居向房東或管委會反映受到吸菸影響，甚或舉證證明因菸味受到困擾或損害，那麼可以依公寓大樓管理條例第16條和第47條，請求管委會制止或按照規約處理。如果經制止後仍不遵從，則可報請地方政府協助處理，根據規定，主管機關可以開罰罰金，屢犯則可以連續開罰。或者是根據民法第793條規定，要求禁止對方散播臭氣、煙氣到自己的空間，如果勸阻無效，還是可以依據民法195條向法院請求賠償。

但須特別注意的是，舉證的證明效果，還是由法院認定。

台中市豐原區就有一對夫妻，因鄰居常在陽台抽菸，深受飄入的菸味困擾，買了空氣清淨機維持空氣清潔外，也委託管委會協調、溝通無效後，自行蒐證，以空氣清淨機數值為證據，到法院提告，證明只要鄰居抽菸，空氣污染指數就會上升，確實造成生活品質與健康不利影響。最終法院判決鄰居須賠償，且不得有讓二手菸飄入受害鄰居屋內的抽菸行為。

在陽台吸菸，其實菸味是很容易飄散進建築物室內，影響到鄰居，也影響到家人。建議犯菸癮、非抽不可時，最好到無人的戶外空間，保障大眾健康。

3.     In short, try not to smoke on your balconies unless you really need to.
